These terms and conditions of access and use, the Table Fables Privacy Policy, and all supplemental terms (the 'Terms') govern your access and use of all Table Fables learning resources, online programs, mobile products, applications, websites and related events (each being the “Site” for the purposes of these terms and conditions) offered by Us ('Table Fables Services') and made available to you ('You'/'Your'/'User') whether via static or mobile devices and whether in native or mobile application format. By accessing, using or installing any of these Table Fables Services, You accept and agree to be bound by these Terms. If you do not agree to these Terms then do not access or use the Table Fables Services. By using the Table Fables Services, you affirm that you are at least 18 years of age (or have reached the age of majority if that is not 18 years of age where you live) or that you have reviewed these Terms with your parent or guardian and he or she assents to these Terms on your behalf and takes full responsibility for your compliance with them. You agree that you and/or your parent or guardian are fully able and competent to enter into the Terms and abide and comply with these Terms. We recommend that you print a copy of these terms for future reference.

Table Fables Services are made available by Table Fables Limited, a limited company registered in England and Wales under registration number 10700047 and our registered address is 39 Melrose Avenue ( We"/"Us"/"Our"/”Table Fables”). Your access to and use of the Site (collectively, your “Access”) is conditional on your acceptance and compliance with these Terms. Your Access to the Site constitutes your agreement to be legally bound by these Terms. We reserve the right to revise, amend and update the Terms at any time effective on the date of posting to the Site of the new and amended provisions. Your continued use of our Site and Table Fables Services will be deemed your acceptance of these amended Terms. We may, without notice, update and change the Site from time to time to improve and/or add to the Table Fables Services and/or to reflect changes to our products, our users’ needs and/or our business priorities.

Access Terms

Users (including students or teachers) found to be intentionally misusing the Site or to be in breach of these Terms (e.g. hacking or sending fraudulent results) will have their access to the Site immediately revoked. Users shall not use offensive, disrespectful or inappropriate words as part of their usernames or password. Users of the Site must agree to the Table Fables Privacy Policy [https://www.tablefables.net/public/TermsandConditions.aspx]. By your use of the Site you consent to the collection, storage, use and dissemination of your personal information in accordance with this Privacy Policy. If any information You provide in connection with your registration is untrue, inaccurate, out-of-date or incomplete then We reserve the right to refuse Your current and future use of the Table Fables Services and Site and in such event the licence granted to You under these Terms will be suspended and/or terminated. If You choose, or You are provided with, a password or any other piece of information as part of Our security procedures, You must treat such information as confidential. You must protect both usernames and passwords from unauthorised use and You must not disclose it to any third party. We have the right to disable any password, whether chosen by You or allocated by Us, at any time, if in Our reasonable opinion You have failed to comply with any of the provisions of these Terms. If you know or suspect that anyone other than you knows your password, you must promptly notify us at [info@tablefables.net] or update your password at [https://www.tablefables.net/public/SendPassword.aspx]. You are also responsible for ensuring that all persons who access our site through Your internet connection are aware of the Terms and other applicable terms and conditions, and that they comply with them.

Anonymous Information: Terms of use

We collect anonymous information about You and Your activities on the Site. Anonymous information is information that is not linked to Your identity and which does not identify the individual. This is primarily used to assist Us in enhancing the Table Fables Services and the information remains anonymous at all times. By using the Site You grant Us the right to use this anonymous information for Our own purposes, such as the preparation of statistical reports, provided We otherwise comply with Our obligations in respect of the use of personal information. Site Availability We do not guarantee or warrant that the Site, or any content on it, will always be available or be uninterrupted or will be without delay, error-free, free of viruses or omission-free. We may suspend or withdraw or restrict the availability of all or any part of the Site for business and operational reasons at any time.

Ownership of content on the site

You acknowledge that all intellectual property rights in the Site and Table Fables Services and all Content appearing within the Table Fables Services and Site throughout the world belong to Us, Our licensors or affiliates. You acknowledge that rights in the Table Fables Services are licensed to You and You do not acquire any rights other than the right to use the Table Fables Services and Site under these Terms. “Content” means the software, video, audio, music, text, characters, communications, images, sounds and all material and information displayed on and/or included within the Site and any related services. Such Content is protected by copyright, trademark and other laws and treaties around the world. All such rights are reserved. You may not in any form or by any means modify, adapt, reproduce, copy, store, distribute, republish, print, display, perform, publish, frame, download onto a computer, upload to a third party, post, transmit or create derivative works from any part of the Site or any Content appearing within the Table Fables Services or Site except as expressly permitted pursuant to these Terms or with Our express prior written consent.

Linking

You may link to our home page, provided that You do so in a way that is fair and legal and does not damage Our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on Our part where none exists. We reserve the right to require You to remove any link to the Site immediately upon notice.

Access to the site

You may view the Site using your web browser and save an electronic copy, or print out a copy, of parts of this Site solely for your own personal use, information, research or study, but only if you keep all Content intact and in the same form as presented on the Site (including without limitation all copyright, trade mark and other proprietary notices and all advertisements). You must not Access or use the Site or the Content in any manner or for any purpose which is illegal or prohibited by any laws that apply to you, violates our rights in any way, or is prohibited by these Terms (including, without limitation, the Acceptable Use Policy). We do not guarantee that the Site will be secure or free from bugs, viruses or similar. You are responsible for configuring your information technology, computer programmes and platform to access the Site and You must take your own precautions to ensure that the process which you employ for accessing the Site does not expose you to the risk of viruses, malicious computer code or other forms of interference, which may damage your own computer system. You should use Your own virus protection software and satisfy yourself of its effectiveness. With the exception of interference or damage attributable to a wilful act or the gross negligence of Us, We do not accept responsibility for any interference or damage to your own computer system or data, which arises in connection with your Access. A paid subscription to any Table Fables Services permits the subscribed user Access to the Site in its native format across both static and mobile devices. Table Fables reserves the right to levy additional charges for access to resources outside of this limitation. Any such additional charges will be clearly notified to You. In some cases, additional subscription charges may be levied for non-native access, premium additional content, printed content, mobile device access to standalone components of the Table Fables Services as well as special Table Fables events. You must not use the Content for commercial purposes without first obtaining our express written authority.

Home Subscription Terms

Table Fables home subscription licences are for individual and non-commercial purposes only and are non-transferable and non sub-licensable. Users are responsible for their own internet usage charges. It is the responsibility of the user to ensure their computer and internet access is sufficient to access the Site and Table Fables Services. Any students which We determine are intentionally misusing the Site (including, without limitation, by hacking the Site or) will have their licences revoked without refund upon notice. Web-delivered goods are supplied immediately upon processing of credit card details. All taxes are detailed on the tax invoice provided to You. Card types accepted: Visa, MasterCard, Amex and Diners cards. Customer Service Policy: All goods/services supplied will be in good working order. All faulty goods will be exchanged for a working version at no additional cost to the client. Credit Card Transaction Policy: All credit card transactions are completed over a secure internet connection using 128bit SSL encryption. Digital certificates are used to maximise security when receiving credit card information. Consumer Data Policy: Purchasing information provided from online transactions is used for accounting purposes only. Stringent physical and technological measures are taken to protect customer information. The fees You pay for the Table Fable Services may be amended by Us upon at least 30 calendar days’ notice at any time.

School Subscription Terms

Table Fables will supply the Table Fables Services to You under a licence to use them (the “Licence”) in accordance with these Terms. The Licence provided to You allows an assigned number of students selected by You the right to use the purchased product(s) at home or school. Charges to You by Table Fables are based on the number of unique students You have requested receive access to the Table Fables Services and the Site. You can transfer the right to access the Site and Table Fables Services from an existing student to a new student at no additional cost, but only once the previous student’s use of the product has ended. If more than the number of students requested by You to use the Table Fables Services and Site use the same, then Table Fables has the right to invoice You for the access provided to the additional students and You shall pay such invoice within 30 calendar days of receipt. Where this agreement relates to an individual school subscription, licences must be assigned to student users within Your school. You will have access to content or tools available within the product(s) at no extra charge. Table Fables Services are continuously evolving. Table Fables will at Table Fables’ discretion provide upgrades and enhancements free of charge. Table Fables reserves the right to delete, modify, change, evolve and improve existing content or tools at any time without notice to, or consent from, You. Table Fables will provide email support services to You. Contact details for such support can be found at [https://www.tablefables.net/public/ContactUs.aspx]. Additional remote or face-to-face training may be chargeable. The Licence and the pricing agreed between us are effective for the period (the “Subscription Period”) outlined in the quotation and invoice (the “Commercial Conditions”). The price per student applied to these Commercial Conditions will also apply to any additional students purchased before the end date of this Subscription Period. An invoice will be raised once the terms of Our quotation are accepted. All amounts will be payable in full within 30 calendar days from date of invoice, unless the invoiced amount is disputed within 15 calendar days from the invoice date. Except as otherwise provided in these Terms, purchases of Table Fables Services are non-refundable. For all digital content and services to be provided to You, You expressly waive your rights to cancel any contract between You and Table Fables within 14 days of any contract existing in respect of Table Fables Services. Table Fables reserves the right to suspend user licences pending payment of invoices. Unpaid invoices will be subject to a 5% administration charge and a 5% per annum interest charge. The Customer will be liable for collection costs and legal costs on the basis of a solicitor and his own client for any costs incurred by Table Fables in collecting balances due on unpaid invoices. Notice of change to Your contact information must be provided in writing to Table Fables immediately at the time of change. This is a confidential agreement between You and Table Fables. Disclosure of pricing information to other persons or entities, external, internal, related or unrelated parties (other than those parties requiring information in the normal course of duties) is strictly prohibited. The submission of an order assumes that the requester has the full authority to place the order.

Disclaimer and limitation of liability

Although we have no reason to believe that any information contained in the Site is inaccurate, We make no representations, warranties or guarantees, whether express or implied that the Site and/or the Table Fable Services are accurate, complete or adequate, nor do we undertake to keep the Site updated. To the maximum extent permissible by law, We do not accept responsibility for loss suffered as a result of your reliance on the accuracy, adequacy or completeness of information contained in this Site. The Content is provided “as is” without warranties of any kind, express or implied, including as to accuracy, timeliness and completeness. We do not exclude or limit in any way our liability to You where it would be unlawful to do so. This includes liability for death or personal injury caused by Our negligence or the negligence of Our employees, agents or subcontractors and for fraud or fraudulent misrepresentation. We exclude all implied conditions, warranties, representations or other terms that may apply to the Site or any Content to the extent permissible by applicable law. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

• use of, or inability to use, the Site; or
• use of or reliance on any content displayed on the Site.

In particular, we will not be liable for:

• loss of profits, sales, business, or revenue;
• business interruption;
• loss of anticipated savings;
• loss of business opportunity, goodwill or reputation; or
• any indirect or consequential loss or damage.

Suspension and Termination

We may suspend, restrict or terminate access to this Site or any part of the Table Fables Services in the event that: (a) You breach of any of the restrictions or provisions in these Terms; (b) there is a system failure, a need for maintenance or repair or otherwise such suspension, restriction or termination is due to events beyond Our reasonable control; and/or (c) We decide to withdraw the Site, or any other part of the Table Fables Services from the market for any reason in Our sole discretion. Upon termination, Your rights and licence granted herein will terminate and You must cease all use of the Site and/or Table Fables Services, as requested by Table Fables.

Advertising and links to other web sites

Where the Site contains links to other sites and resources provided by third parties, these links are provided for Your information only. Such links should not be interpreted as an endorsement or approval by Us of those linked websites or information You may obtain from them. Your link to any such website is at Your own risk. We do not have any control over the contents of any linked website and therefore do not give any representation or warranty as to the reliability, accuracy or completeness of any such linked websites, nor do We accept any responsibility arising in any way for errors in, or omissions from the same.

General

If any of these Terms are held to be invalid, unenforceable or illegal for any reason whatsoever, the remaining terms and conditions of these Terms shall continue in full force and effect. We do not accept any liability for any failure to comply with these Terms where the failure is due to circumstances beyond Our reasonable control. If we waive any rights available to Us under these Terms on any occasion, this does not mean that those rights will automatically be waived by Us on any other occasion.

Governing Law

In the event of any dispute between You and Us concerning these Terms, the laws of England and Wales will apply, to the extent permitted by local law. If You wish to take court proceedings against Us, You must do so within England and Wales.

Challenges and competitions

Table Fables may host challenges and/or competitions on the Site. These Terms and the Table Fables Privacy Policy shall apply to all such challenges and/or competitions. A leaderboard or other communication of positions or progress for a challenge or competition shall not determine the final result. All results shall be verified after the relevant challenge or competition. We shall have the right, in Our sole discretion, to determine the final positions and the winners of the challenge and/or competition (as appropriate). In the event that You do not comply with these Terms, You may be removed from the leader board or disqualified from the challenge and/or competition at any time in Our sole discretion. We shall be entitled to require that students, classes and/or schools provide proof of age and/or sign a declaration that they individually and collectively participated without assistance from any other person, software, hardware or device. Any students, classes or schools which intentionally misuse the Site shall be disqualified or removed from the leader board of the competition or challenge, including, without limitation, by computer hacking the Site, by posting fraudulent results, by using computer scripts to improve responses and/or scores or by otherwise misusing the Site. Where a prize is advertised for a challenge or competition, We may, in our discretion, substitute the same for something of equivalent value, as determined by us or the prize provider in our sole discretion.

17 Day Challenge

You must complete all days, number and levels in the order as specified below. You do not need to score 100% on days 1 to 16 however you must finish all the questions. On day 17 you must score 100% to complete the challange. The money back amount (£50 for 12 months subscription, £20 for 6 months subscription, £10 for monthly subscription ) will only be paid the first time you successfully complete the 17 Day Challenge. For multi-child family subscriptions there is only one money back amount per family. To be eligible for a prize you must purchase a new subscription. This challenge may be withdrawn at any time.

Referrals

If you referrer the most people to the site in a given calendar month and they sign-up, you will win a cash prize. To referrer someone, sign-in to the site, go to the My Profile page and provide your friend your referrer code, found underneath your email.
